Passage of S2461 an Act Further Regulating the Consignment of Fine Art

WHAT: Senate Bill 2461 passed into law clarifies and improves on the
previous important statute. This new law expands protection for both
artists and owners of art who wish to attempt to sell their art, as
well as the consignees of fine art. It provides transparency and
predictability and reestablishes trust in the marketplace.
WHY: The previous law governing the consignment of fine art in
Massachusetts, chapter 104A, was recently tested in 2 key legal cases:
The Boston Corporate Art (2003) and Haley and Steele (2005).
Unfortunately the law fell short in protecting the artists,
consignors and consignees of fine art. The literal interpretation and
application of Chapter 104A proved problematic. Senate Bill 2461 will
help to ensure transparency and provide a good business template for both
consignees and consignors of fine art who follow sound business
practices.
